―孤児の加護と孤児の財産の保全―
あらゆる称賛は慈悲に富み、慈悲深いアッラーのもの。預言者ムハムマド、その一家、教友たちに祝福と平安がもたらされますように。

子供はアッラーから父親への賜り物である。
アッラーは、クルアーン・洞窟章及び相談章において次ぎように述べておられる。
「富と子女はこの世での生活の装飾である。…」(18章 46節)
「天と地の大権はアッラーのもの。その御方は御心のままに創造なされる。その御方は、御望みの者に女児を、また御望みの者に男児を授けられる。」「また男と女の両方を(授け)、そして御望みの者を不妊になされる。誠、アッラーは全知にして強力であられる。」(42章 49--50節)

ところで、子供が親を失うとき、子供は、父親からの慈愛、愛情、庇護を失う。それは子供にとって誠に大きな損失であり、それ故彼らは孤児と呼ばれるのである。イスラームでは、孤児を世話することを重要なことであると強調されている。
アッラーがクルアーン・婦人章において次ぎように述べておられる通りである。
「アッラーに仕えなさい。何ものをもアッラーに併置してはならない。父母に親切を尽くし、また近親や孤児、貧者や血縁のある隣人、血縁のない隣人、道連れの仲間や旅行者、及びお前たちの右手が所有する者(に親切であれ)。アッラーは、高慢な者、うぬぼれる者を御好みではない。」(4章 36節)
多くの預言者の言葉は、信仰心篤いムスリムたちが、孤児の援助者となり、良くお世話し、親切にし、愛情を表すのを駆り立てている。例えば、預言者さま(祝福と平安を)は、中指と人差し指の2本の指を差し出しながら、「私と孤児の庇護者は天国においてはこれら2本の指の様である。」

信者たちよ、孤児を世話する事は、審判の日の懲罰から救われる手立ての一つである。
アッラーは、クルアーン・町章において次のように述べておられる。
「だが彼は険しい道を取ろうとはしない。」「険しい道は何であるかを、お前に理解させるものはなにか。」「(それは)奴隷を解放し、」「また飢餓の日には食物を出して、」「近い縁者の孤児を、」「また酷く哀れな貧者を(養うこと)。」(90章 11--16節)
アッラーは、正しい心で孤児を世話する事に、他より先んずるようにと我々に命令しておられる。その為、このことに関する我々の係わりにあって、怠慢や独りよがりは、最も憎むべき違反ないし悪事と数えられるのである。
アッラーは、クルアーン・暁章において次のように述べておられる。
「断じていけない。いや、お前たちは孤児を大切にしない。」「また、貧者を養う為に互いに励まさない。」(89章 17--18節)

また、クルアーンの別な章節でアッラーは、孤児に対しどんな危害も虐待も加えることについて、はっきりと警鐘をならしておられる。アッラーは、クルアーン・朝章及び慈善章において次のように述べておられる。
「だから孤児を虐げてはならない。」(93章 9節)
「お前は、審判を嘘であるとする者を見たか。」「彼は、孤児に手荒くする者であり、」「また、貧者に食物を与えることを勧めない者である。」(107章 1--3節)
更に、アッラーは、孤児の為に自ら費やすことを命じておられる。
アッラーは、クルアーン・雌牛章において次のように述べておられる。
「彼らは如何に施すべきか、あなたに問うであろう。言ってやるがいい。『あなた方が施して良いのは両親の為、近親、孤児、貧者と旅路にある者の為である。誠、アッラーはお前たちの善行を何でも深く承知でおられる。』
」(2章 215節)
「…また、彼らは孤児に関し問うであろう。言ってやるがいい。『彼らの為に有利に計らうのは善いことである。もし彼らと親しく交わるときは、お前たちは兄弟である。』アッラーは善意の者と、悪事をなす者を知っておられる。…」(2章 220節)

その上、アッラーは、孤児の財産を保全するように命じておられる。
アッラーは、クルアーン・家畜章において次のように述べておられる。
「孤児が成人に達するまでは、最善の管理の為の外、お前はその財産に近付いてはならない。…」(6章 152節)
そして、アッラーは、孤児の財産を引き渡す前に、その孤児が自分自身の事を確実に管理出来るかどうかを確かめるようにと命じておられる。
アッラーは、クルアーン・婦人章において次のように述べておられる。
「結婚年齢に達するまでは孤児を試しなさい。もし、立派な分別があると認めたならば、その財産を彼に渡しなさい。彼ら(孤児)は青年になるまでに浪費したり、急いで消費してはならない。…」(4章 6節)

そして更に、アッラーは、孤児の財産を不正に使ってしまうことに対して強い警告を発しておられる。
アッラーは、クルアーン・雌牛章において次のように述べておられる。
「不当に孤児の財産を食い減らす者は、本当に腹の中に火を食らう者。彼らはやがて烈火に焼かれるであろう。」(4章 10節)
預言者さま(祝福と平安を)は、由々しい悪事について次のように述べられた。「破滅の原因となる7つの由々しい悪事を避けなさい。アッラーと並べて他をも崇拝すること。妖術を使うこと。正当な理由がないのに人の生命を絶つこと。利息を扱うこと。孤児の財産をむさぼり食うこと。戦場から逃げること。それと、無垢で純情な信仰心篤い女性を犯すこと。」

信者たちよ、預言者ムハムマド(祝福と平安を)は孤児であった。祝福された預言者であり、孤児の惨めな生活振りの体験者であるが故に、孤児たちを守りお世話なされた。実際には、ムハムマド(祝福と平安を)は、両親からの加護を受けていた。父親を見ることは無かったし、6歳で母を失ったが、全能のアッラーは、ムハムマド(祝福と平安を)を一人にはしておかれなかっただけではなく、守った上に、最高の人間となされたのである。アッラーは、クルアーン・朝章において次のように述べておられる。
「アッラーは孤児のあなたを見付けられ、庇護なされたではないか。」「その御方は彷徨っていたあなたを見付けて、導きを与え下さった。」「また、貧しいあなたを見付けて、裕福になされたではないか。」(93章 6?8節)
孤児の庇護者である者は、彼を育て上げ、生計、衣類、修養、教育その他の世話をする者である。正しい思慮に基づけば、孤児たちに対する鍵と言うべき姿勢とは、親切である事でなければならず、孤児たちは社会全体に属し、誰もが孤児たちの幸福に責任を負うものである。恐らくこれは高尚な道義に帰するものであり、即ちムスリムは、恵まれない人に慈悲深くある事が要求されるが、孤児であることの身の上は、イスラームにとってはもっと深遠な意味を持つのであるにちがいない。

付け加えるなら、孤児の保護者は、孤児が自分の財産を正しく処理できる様になるまで守ってあげる責任がある。養子関係を結んだ家族は、孤児の所持品、財産を自分のそれと一緒にしてしまう事は許されない。
アッラーは、クルアーン・婦人章において次のように述べておられる。
「孤児たちの財産を返還しなさい。(自分の)悪いものを(彼らの)良いものと替えてはならない。また、彼らの財産を我がものにしてはならない。まこと、それは大罪である。」(4章 2節)

アッラーよ、アッラーの道を忠実に歩めるように御加護下さい。
アッラーよ、貴方様の御悦びの為だけに何事も出来る様に御加護下さい。
アッラーよ、ムスリムたちから貧困や困難を取り除き、仕事の無い者たちに、清い仕事を与えて下さい。
アッラーよ、祈願をする皆の願いを叶えて下さい。病気の者たちを治してあげて下さい。
アッラーよ、我々がアッラーの御名を讃え広め、日本でイスラームを広められるよう御導き下さい。アミィーン。

Translation of Khutba (Friday March 12, 2010)

All praise is due to Allah, the Beneficent and the Merciful.  May peace and blessings be upon our Prophet Muhammad, his family and companions.

A Child is a blessing from Allah (SWT) to the father. Allah said in the Quran in Surah AlKahf and Surat Ashoura:
“Wealth and children are the adornment of the life of this world….” (S.18 V. 46).
“To Allah belongs the kingdom of the heavens and the earth. He creates what He wills. He bestows female (offspring) upon whom He wills, and bestows male (offspring) upon whom He wills..” ”Or He bestows both males and females, and He renders barren whom He wills. Verily, He is the All-Knower and is Able to do all things.” (S.42 V.49--50)

And when the child loses his or her father, he/she loses that love, that affection and that protection. It is indeed a great loss for the child and that’s why he/she is called orphan. Islam emphasises the importnace of taking care of orphans. Allah said in the Quran in Surat Annissa:
“Worship Allah and join none with Him (in worship), and do good to parents, kinsfolk, orphans, Al-Masakin (the poor), the neighbour who is near of kin, the neighbour who is a stranger, the companion by your side, the wayfarer (you meet), and those (slaves) whom your right hands possess. Verily, Allah does not like such as are proud and boastful.” (S.4 V.36)
Many Prophetic statements have been reported as urging believing Muslims to sponsor orphans, take good care of them, be kind to them, and demonstrate love and affection for them. For instance the Prophet (Peace be upon Him) said: "I and the guardian of an orphan are like these two in Paradise." He then indicated with his index and middle fingers. (Bukhari -4998)

O Muslims, taking care of orphans is a way of salvation from punishiment on the day of judgement.
Allah said in the Quran in Surat Al-Balad:
“But he has not attempted to pass on the path that is steep (i.e. the path which will lead to goodness and success). “” And what will make you know the path that is steep? “” (It is) Freeing a neck (slave)””Or giving food in a day of hunger (famine), “”To an orphan near of kin.””Or to a Miskin (poor) cleaving to dust (out of misery).” (S.90 V.11--16)
Allah orders us to excel in rendering honorable treatment towards orphans; therefore, any failure or complacency on our part in this regard is reckoned as a most heinous offence and sin.
Allah says in the Quran in Surat Al-Fajr:
“Nay! But you treat not the orphans with kindness and generosity (i.e. you neither treat them well, nor give them their exact right of inheritance)! “”And urge not one another on the feeding of AlMiskin (the poor)! “ (S.89 V. 17-- 18)
Elsewhere in the Quran, Allah explicitly warns us against inflicting any kind of harm or abuse on an orphan.
Allah said in the Quran in Surat Ad-Duha and Surat Al-Maun:
“As for the orphan do not oppress him.” ( S.93 V.9)
“Have you seen him who denies the Recompense? “”That is he who repulses the orphan (harshly),””And urges not on the feeding of AlMiskin (the poor),” (S.107 V.1--3)
Moreover Allah has commanded to spend on orphans:. Allah said in the Quran in Surat Al-Baqara:
“They ask you (O Muhammad SAW) what they should spend. Say: Whatever you spend of good must be for parents and kindred and orphans and AlMasakin (the poor) and the wayfarers, and whatever you do of good deeds, truly, Allah knows it well.” (S.2 V.215)
“…And they ask you concerning orphans. Say: "The best thing is to work honestly in their property, and if you mix your affairs with theirs, then they are your brothers. And Allah knows him who means mischief (e.g. to swallow their property) from him who means good (e.g. to save their property)…." (S.2 V.220)
Also Allah ordered to protect the wealth of orphans. Allah said in the Quran in Surat Al-Anaam:
“And come not near to the orphan's property, except to improve it, until he (or she) attains the age of full strength…” (S.6 V.152)
And He commanded to test the orphans before giving them their money in order to be sure of their ability to manage their affairs well. Allah said in the Quran in Surat Al-Nissa:
“And try orphans (as regards their intelligence) until they reach the age of marriage; if then you find sound judgement in them, release their property to them, but consume it not wastefully, and hastily fearing that they should grow up…” (S.4 V.6)
Further, Allah has warned strongly against eating the property of orphans unjustly:
Allah said in the Quran in Surat Al-Nissa:
“Verily, those who unjustly eat up the property of orphans, they eat up only a fire into their bellies, and they will be burnt in the blazing Fire! “ (S.4 V.10)
And about the big sins the Prophet (PBH) said : "Avoid the seven cardinal sins that cause destruction." The companions asked: "O Prophet of Allah! What are these sins?" He (Peace be upon Him) said: "To associate others in the worship of Allah, to practice sorcery, to kill a human soul for no just reason, to deal with interest, to devour the wealth of an orphan, to flee from the battlefield, and to accuse the innocent, chaste, believing women with adultery." (Bukhari #2615 & Muslim #89 )
Slaves of Allah, The Prophet Muhammad (PBUH) was an orphan. He was the Prophet of mercy, the orphan who chose to protect orphans and to take care of them because he already had tasted the miserable life of an orphan. In fact Muhammad (PBUH) was prevented from his parents. He (PBUH) never saw his father and he lost his mother at the age of six but Allah the Almighty did not left him alone. So Allah the Almighty had not only protected Muhammad (PBUH) but also made of him(PBUH) a person with the highest human qualities. Allah the Almighty mentions that in the Quran in Surat Ad-Duha:
“Did He not find you (O Muhammad (SAW)) an orphan and gave you a refuge? “”And He found you unaware (of the Qur'an, its legal laws, and Prophethood) and guided you? “”And He found you poor, and made you rich (selfsufficient with selfcontentment)? “ (S.93 V.6--8)
The one who sponsors an orphan is the one who brings him up and takes care of his affairs with regard to maintenance, clothing, discipline, education and so on. In the sense that the key posture toward orphans should be kindness, orphans belong to the entire community, and everyone takes responsibility for their welfare. Perhaps this can be attributed to a deep spiritual morality that demands Muslims be charitable toward less fortunate others, but the state of being an orphan takes on an even more profound meaning in Islam.

Additionally, an orphan's guardian is responsible for protecting the orphan's inheritance until the orphan is legally able to assume control of it himself. The adoptive family is not allowed to combine an orphan's property or wealth with its own. Allah said in the Quran in Surat An-Nisa:
"Give orphans their property, and do not substitute bad things for good. Do not assimilate their property into your own. Doing that is a serious crime." (S.4 V.2)

Let us pray Allah S.W.T. that He give us Taufiq to act upon the teachings of Prophet Muhammad S.A.W.
May Allah save us from Miseliness.
May Allah give us ability and Taufiq to spend sincerely in the path of Allah.
O! Allaah use us for upholding the Name of Allah and spreading Islam in Japan and may guidance of Islamic faith prevail in Japan and in the world. Aameen.
